Attendance Law
Texas Education Code 25.095(a) requires a school district to notify
a student's parent in writing at the beginning of the school year
that:
If the student is absent from school on:
10 or more days or parts of days
within a six-month period
in the same school year OR
- 3 or more days or parts of days
within a four-week period:
THEN
(1) the student's parent is subject to prosecution in court under
Section 25.093 of the Texas Education Code for the offense of "Contributing
to Truancy ". a Class C misdemeanor with a possible fine of
up to $500 for each offense. Every day the child remains out of
school may constitute a separate offense;
AND
(2) the student is subject to prosecution in court under Section
25.094 of the Texas Education Code for the offense of "Failure
to Attend School", a Class C misdemeanor with a possible fine
of up to $500 for each offense. Every day the child remains out
of school may constitute a separate
offense.
